Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Credo mobile application, websites, and related services (the "Service") provided by Loch Inc. ("Loch Inc.", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or 16 in the EEA / UK) to use the Service. By using Credo you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

You retain ownership of the reflections, recordings, and other content you submit to the Service ("Your Content"). You grant Loch Inc. a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, and display Your Content solely as needed to operate, secure, and improve the Service for you. We do not claim ownership of Your Content and will not use it for advertising.

Loch Inc. offers contemplative, devotional, and educational content through Credo. It is provided for personal reflection and is not medical, psychological, legal, financial, or pastoral advice. If you need professional help, please seek a qualified professional.

6. Subscriptions and purchases

Some features may require a paid subscription or one-time purchase through the Apple App Store or Google Play. Purchases are governed by the applicable platform's terms; refunds are handled by the platform unless otherwise required by law. Free trials, if offered, automatically convert to paid subscriptions unless cancelled before the trial ends.

The Service integrates with third-party providers (for example, Supabase for infrastructure and Google Sign-In for authentication). Your use of those services is governed by their own terms and privacy policies. We are not responsible for the practices of third parties.

8. Intellectual property

Loch Inc., the "Credo" name, logos, and the Service itself (excluding Your Content) are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service in accordance with these Terms.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure for us, or use the Service in a way that could harm others. Sections that by their nature should survive termination (e.g. ownership, disclaimers, limitations of liability) will survive.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, error-free, or that any content will be accurate.

11. Limitation of liability

To the maximum extent permitted by law, Loch Inc. and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD $50.

12. Indemnification

You agree to defend and indemnify Loch Inc. from any claims, damages, or expenses arising out of your use of the Service, Your Content, or your breach of these Terms, except to the extent caused by our gross negligence or willful misconduct.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in San Francisco County, California, and you and Loch Inc. consent to personal jurisdiction there. If you are a consumer in the EEA, UK, or another jurisdiction with mandatory consumer-protection rules, those rules continue to apply.

14. Changes to these Terms

We may modify these Terms from time to time. If changes are material, we will give reasonable notice (e.g. in-app or by email). Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
