End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you ("you" or "End User") and Loch Inc. ("Loch Inc.", "we", "us") governing your use of the Credo mobile application, including all content, features, and services made available through it (the "App"). This EULA supplements our Terms of Service and Privacy Policy, which are incorporated by reference. By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not download or use the App.
1. License grant
Subject to your compliance with this EULA, Loch Inc. grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial purposes. This license does not include the right to sublicense, resell, or otherwise distribute the App to any third party.
2. Apple App Store — additional terms
If you downloaded the App from Apple's App Store, the following additional terms apply. You acknowledge that:
- This EULA is between you and Loch Inc. only, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
- The license granted is limited to using the App on any Apple-branded devices you own or control, as permitted by the App Store usage rules set forth in Apple's Terms of Service.
- Loch Inc., not Apple, is solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation to furnish any such services.
- In the event that the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the App (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App.
- Loch Inc., not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Loch Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
- Apple and Apple's subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance of its terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
3. Restrictions
You agree that you will not, and will not permit others to:
- Copy, modify, adapt, translate, or create derivative works of the App or any part of it.
- Reverse engineer, disassemble, decompile, or attempt to derive the source code of the App, except to the extent that applicable law expressly prohibits such restriction.
- Rent, lease, lend, sell, sublicense, assign, or otherwise transfer rights in or to the App.
- Remove, alter, or obscure any proprietary notice, label, or mark on the App.
- Use the App in any manner that could damage, disable, overburden, or impair our servers, networks, or the experience of other users.
- Use automated scripts, bots, scrapers, or other tools to access, collect content from, or interact with the App.
- Use the App to build a competing product or service, or benchmark the App against another product without our written consent.
4. Community and social features
The App includes an opt-in community feed ("Community") where users may share reflections inspired by quotes and teachings from world traditions. Participation in the Community is entirely voluntary. By opting in and publishing content to the Community, you agree to the following:
Publishing and visibility
- All journal entries are private by default. Content is only shared to the Community when you explicitly choose to publish it. Publishing is a distinct, intentional action — no content is made public automatically.
- Published reflections are visible to other Community members. You may un-publish a reflection at any time; however, residual copies may remain cached for a short period before full removal.
- You may opt out of the Community at any time from your profile settings. Opting out removes your published content from the Community feed.
Reactions and interactions
- Community interactions are limited to a curated set of pre-written empathetic reactions. Free-text comments are not permitted. This design is intentional — it exists to prevent harassment, toxicity, and unsolicited advice.
- You may not attempt to circumvent the pre-written reaction system or use other mechanisms within the App to send unsolicited messages to other users.
- Reactions are intended as expressions of empathy and solidarity. They do not constitute endorsement, agreement, or advice of any kind.
Community conduct
When participating in the Community, you agree not to publish content that:
- Is hateful, discriminatory, or targets individuals or groups based on protected characteristics.
- Harasses, bullies, threatens, or intimidates any person.
- Is sexually explicit, obscene, or pornographic.
- Promotes violence, self-harm, or dangerous activities.
- Contains spam, solicitation, or commercial advertising.
- Impersonates any person or organization, or misrepresents your affiliation.
- Violates the privacy of others — including sharing personal information without consent.
- Infringes any copyright, trademark, or other intellectual property right.
- Proselytizes, pressures, or denigrates others' faith traditions or lack thereof.
Moderation and enforcement
- We reserve the right to review, remove, or restrict any Community content that violates this EULA or our Community guidelines, at our sole discretion and without prior notice.
- Users may report content they believe violates these guidelines using the in-app reporting feature. We will review reports and take appropriate action, which may include content removal, a warning, a temporary suspension, or permanent termination of Community access or your account.
- We may implement automated tools to help detect policy violations. Automated decisions may be reviewed manually upon appeal to prithvir@loch.one.
- We do not guarantee that all violating content will be identified or removed, and we are not liable for content posted by other users.
Blocking and safety
- You may block any Community member at any time. Blocked users cannot see your published content, and you will not see theirs.
- Block records are stored to enforce the block. They are not shared with the blocked party.
5. AI-generated content
The App uses artificial intelligence to generate illustration covers for journal entries and to power the AI Spiritual Mentor feature. You acknowledge that:
- AI-generated illustrations are created in response to the emotional theme of your journal entries. They are decorative and do not reflect any factual analysis of your writing.
- The AI Spiritual Mentor provides perspectives drawn from religious, philosophical, and psychological traditions. Its responses are not professional advice — spiritual, psychological, medical, legal, or otherwise. Always consult a qualified professional for personal decisions.
- AI outputs may be inaccurate, incomplete, or culturally imprecise. Loch Inc. does not warrant the accuracy, completeness, or appropriateness of any AI-generated content.
- AI-generated illustrations produced for your private journal entries belong to you. We do not claim ownership of illustrations generated solely from your private content.
6. Subscriptions and in-app purchases
Certain features of the App require a paid subscription ("Pro"). All purchases are processed by the Apple App Store or Google Play and are subject to their respective terms. Key points:
- Subscription fees are charged to your App Store or Play Store account at the time of purchase and at the start of each renewal period.
- You may cancel your subscription at any time through your App Store or Play Store account settings. Cancellation takes effect at the end of the current billing period — you retain Pro access until then.
- Refunds are handled by Apple or Google under their respective refund policies. Loch Inc. does not control refund eligibility for platform-processed purchases.
- Free trials, if offered, convert automatically to paid subscriptions unless cancelled before the trial period ends.
- We reserve the right to change subscription pricing with reasonable notice. Price changes will not affect your current billing period.
7. Intellectual property
The App, including its design, code, graphics, AI models, curated content, and all other materials (excluding Your Content as defined in our Terms of Service), is owned by Loch Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in this EULA transfers any intellectual property rights to you beyond the limited license granted in Section 1.
The names "Credo Journal" and "Credo", along with associated logos and marks, are proprietary to Loch Inc. You may not use them without our prior written consent.
8. Privacy
Your use of the App is subject to our Privacy Policy, which describes how we collect, use, and share information. By using the App you consent to the data practices described in the Privacy Policy.
9. Third-party content and services
The App may display quotes, scripture passages, and teachings from third-party sources. Such content is provided for personal reflection and educational purposes under applicable fair use and similar doctrines. We do not endorse any particular tradition, teaching, or interpretation. Links to third-party websites or services, if any, are provided for convenience only and we are not responsible for their content or practices.
10. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that any content — including AI-generated content and Community posts — will be accurate, complete, or appropriate for your needs.
11. Limitation of liability
To the maximum extent permitted by applicable law, Loch Inc. and its officers, directors, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, profits, or goodwill — arising out of your use of or inability to use the App or its Community features, even if advised of the possibility of such damages. Our aggregate liability for any claim related to this EULA or the App will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $50.
12. Indemnification
You agree to defend, indemnify, and hold harmless Loch Inc. and its affiliates from and against any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of: (i) your use of the App; (ii) content you publish to the Community; (iii) your violation of this EULA; or (iv) your violation of any third party's rights. Loch Inc. reserves the right to assume exclusive control of any matter for which you are required to indemnify us, at your expense.
13. Term and termination
This EULA is effective from the date you first install or use the App and continues until terminated. Loch Inc. may terminate this EULA and your license immediately if you breach any of its terms. You may terminate this EULA at any time by deleting the App and your account. Upon termination, the license granted in Section 1 ends immediately. Sections 3, 7, 10, 11, 12, and 15 survive termination.
14. Updates
We may release updates, patches, or new versions of the App from time to time. Certain updates may be required to continue using the App. By installing updates you agree that this EULA applies to all updated versions. We reserve the right to modify or discontinue any feature of the App, including Community features, at any time with reasonable notice where practical.
15. Governing law
This EULA is governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Any disputes arising under this EULA will be resolved in the state or federal courts of San Francisco County, California. If you are a consumer in the EEA, UK, or another jurisdiction with mandatory consumer-protection rights, those rights are not affected.
16. Changes to this EULA
We may update this EULA from time to time. If changes are material, we will notify you via the App or by email at least 14 days before the changes take effect. Continued use of the App after the effective date constitutes your acceptance of the revised EULA. If you do not accept the changes, you must stop using the App.
